General rental conditions

Conditions of the motorbike rental service: driver requirements, booking and payment, deposit, handover and return, use of the vehicle, insurance and liability.

1. Purpose and parties

These General conditions govern the self-drive rental of motorbikes and scooters of up to 125 cc (hereinafter, the “vehicle”) offered by COSTA ODN S.L. (Tax ID pending publication, San Pedro de Alcántara, Málaga; hereinafter, “rida” or the “lessor”) through https://www.ridarentals.com. By confirming a booking, the customer (the “renter” or “driver”) declares that they have read and accepted these conditions, the Cancellation policy and the Privacy policy, which form part of the rental contract.

2. Driver requirements

  • Be at least 18 years old on the pick-up date.
  • Hold a valid driving licence that authorises the vehicle: A1, A2 or A; or a category B licence held for at least 3 years, which in Spain authorises riding motorbikes of up to 125 cc and 11 kW with automatic transmission, like our entire fleet. The minimum licence stated on each vehicle’s page prevails.
  • Licences issued in the EU or EEA are valid directly. Licences from other countries must be accompanied by an international driving permit or an official translation, and their validity is subject to Spanish regulations.
  • Present a valid identity document (ID card, NIE or passport).
  • When booking, the type and number of the identity document and the number, categories and issue date of the driving licence are provided. No photographs or copies of the documents are uploaded or stored: on pick-up day our staff check the originals in person. If they do not match the data provided, are expired or do not authorise the vehicle, the vehicle will not be handed over and the booking will be treated as a late cancellation.

Only the driver registered in the booking may ride the vehicle. Additional drivers are not allowed unless they are registered and verified under the same requirements before handover.

3. Booking, price and payment

Bookings are made online by selecting a vehicle and dates. The rental price (VAT included) is paid in full at the time of booking by card through Banco de Sabadell’s secure PAYCOMET payment platform, with 3-D Secure authentication. The booking is confirmed when you receive the confirmation email with the booking code and the check-in QR code; until then there is no obligation to hand over the vehicle.

The price includes the use of the vehicle during the contracted period, compulsory third-party liability insurance, one approved helmet per driver and mileage within the province of Málaga. It does not include fuel consumed, fines, tolls or additional services contracted separately.

Rentals are counted in 24-hour days from the agreed pick-up time. A simplified invoice (Royal Decree 1619/2012) is issued automatically when booking; if you need a full invoice with your tax details, request it at reservas@ridarentals.com quoting the booking code.

4. Deposit

Each vehicle has a deposit whose amount is shown on its page and in the booking confirmation. The deposit guarantees performance of the contract and covers damage, theft, fines, costs and penalties provided for in these conditions.

The deposit is charged together with the rental when booking, on the same card, and refunded in full to that card after the vehicle is returned without incident.

The release of a pre-authorisation or the crediting of a refund usually appears in your account within 7 to 14 working days, depending on your bank; rida has no control over that period. If the vehicle is returned with damage, missing fuel or other incidents, the corresponding amount will be withheld or charged from the deposit and you will be given the details and supporting documents; if the amount exceeds the deposit, the renter must pay the difference.

5. Stored card and subsequent charges (MIT)

When you pay for the booking, your card is tokenised: PAYCOMET replaces its details with an encrypted reference (token) that is stored within the payment platform itself. rida never knows or stores the full card number or its CVV. That first payment is authenticated with 3-D Secure.

By accepting these conditions, the renter expressly authorises COSTA ODN S.L. to use that token for subsequent merchant-initiated charges (MIT transactions, without the cardholder having to be present or authenticate again), solely for the following items provided for in this contract:

  • Damage to the vehicle, theft or loss of accessories documented in the return report or detected afterwards, within the limits of the insurance, damage and liability clause.
  • Handling fees for traffic fines and penalties incurred during the rental (€30 per case).
  • Fuel not replenished (cost of refuelling plus a €10 handling fee).
  • Late return, as set out in the handover and return clause.
  • Rental extensions requested by the renter.

Before making each charge we will send you prior notice by email with the item, the amount and the supporting documents (return report, photographs of the vehicle, repair estimate or invoice, notice of the penalty). If you disagree with the charge, you may dispute it by replying to that email. Each charge comes with its invoice or receipt.

You may ask us at any time to delete your stored card details by writing to reservas@ridarentals.com. We will delete the token once the rental has ended, the deposit has been released or refunded and any pending claims (damage or fines already notified) have been closed; if you ask earlier, we will keep it only while amounts remain outstanding. In any case, the token is deleted automatically when it is no longer needed and at the latest 12 months after the end of the rental. Withdrawing this authorisation does not prevent us from claiming by other means any amounts owed under this contract.

6. Payments, cancellations and refunds policy

  • When you are charged: the full rental price and the deposit, when booking. Subsequent charges are only made for the items and with the prior notice described in the stored card and subsequent charges clause. All amounts are in euros and include VAT.
  • Release of the deposit: when the return report is closed with no incidents, we cancel the pre-authorisation at that moment or, at the latest, on the next working day; if the deposit was charged, we refund it within the same period. Your bank normally takes 7 to 14 working days to reflect it (up to 30 days for some pre-authorisations, depending on the bank).
  • Refunds: always to the same card used for payment, through PAYCOMET; never in cash or to another card. We process them within 2 working days at most from the cancellation or the closing of the rental and email you the receipt.
  • Cancellations and changes: governed by the Cancellation policy published at https://www.ridarentals.com, which forms part of these conditions. In summary: free cancellation with a full refund of the rental when notified with the minimum notice indicated; with less notice or if you do not show up, the rental is not refunded; the deposit is always released. In accordance with article 103 l) of Royal Legislative Decree 1/2007, the 14-day right of withdrawal does not apply to the rental of vehicles with a specific date of performance.
  • On your bank statement the charge will appear under the name COSTA ODN S.L. or the rida brand.

If you do not recognise a charge or disagree with it, please write to us before starting a reversal or chargeback with your bank, quoting the booking code. We will reply within 2 working days at most with the details and supporting documents and, if the charge is incorrect, we will refund it immediately. Contact:

7. Handover and return

Handover and return take place at our premises in San Pedro de Alcántara (Marbella), Málaga, on the date and time indicated in the booking and within the opening hours we tell you in the confirmation. At check-in, staff scan your booking’s QR code, check your identity and driving licence, formalise the deposit and complete the handover report with you: mileage, fuel level, photographs of the vehicle’s condition and helmet handed over. Inspect the vehicle and have any pre-existing damage recorded in the report.

The vehicle must be returned to the same place, on the agreed date and time, in the same condition and with the same fuel level. On return, the return report (mileage, fuel, damage) is completed and serves as the basis for releasing the deposit.

  • Late return: a 30-minute tolerance is allowed. After that, each hour or part thereof is charged as an extra hour at 25% of the vehicle’s daily price and, beyond 4 hours, a full additional day is charged. If the delay prevents handover to another customer, the renter will also be liable for the damage caused. A delay of more than 24 hours without communication will be treated as misappropriation and reported to the authorities.
  • Fuel: if the vehicle is returned with less fuel, the cost of refuelling plus a €10 handling fee will be charged.
  • Helmet and accessories: in the event of loss or damage, the replacement cost will be charged.
  • Return outside opening hours or without staff present: the vehicle remains the renter’s responsibility until staff verify its condition.

8. Permitted use of the vehicle

The renter undertakes to use the vehicle with due care and in accordance with the Spanish General Traffic Regulations, and in particular to: always wear the helmet; not ride under the influence of alcohol, drugs or medication that affects riding; not carry more passengers than authorised; not lend or sublet the vehicle; not use it for the paid transport of people or goods, competitions, tests, driving instruction or on unpaved roads; not leave the province of Málaga without written authorisation from rida and under no circumstances take it out of Spain; not transport it on another vehicle; and not carry out repairs or modifications without authorisation.

The vehicle must always be parked with the steering lock engaged and in safe places; the keys and documents must not be left in the vehicle.

9. Insurance, damage and liability

All vehicles carry the compulsory third-party liability insurance required by law. This insurance does not cover damage to the rented vehicle itself, its theft or injuries to the driver, unless other cover is indicated on the vehicle’s page.

  • Damage to the vehicle, theft or loss occurring during the rental with use in accordance with these conditions: the renter is liable up to the amount of the deposit, which acts as an excess. rida will give you the damage assessment and supporting documents.
  • Use contrary to these conditions (unauthorised driver, alcohol or drugs, leaving the authorised area, gross negligence, abandoning the vehicle, keys left in the vehicle): the renter is liable for all damages, including the value of the vehicle and the days out of service, without the limit of the deposit.
  • Fines and penalties: traffic and parking offences and other penalties incurred during the rental are borne by the renter. rida, as the vehicle’s owner, is obliged to identify the driver to the authorities (art. 11 of the Traffic Law). A €30 handling fee will also be charged for each penalty processed.
  • Personal belongings: rida is not responsible for items left in the vehicle.

10. Breakdowns, accidents and theft

In the event of a breakdown, accident or theft, the renter must immediately notify rida by email or phone and follow its instructions. In the event of an accident involving third parties, they must complete the European accident report form (or request a police report if there are injuries or disagreement), note the details of the other parties involved and of witnesses, and not admit liability. In the event of theft, they must file a report with the Police or Guardia Civil within 24 hours and hand over a copy together with the keys.

Breakdowns due to normal wear or a defect in the vehicle are borne by rida, which will replace the vehicle if possible or refund the proportional part of the rental not enjoyed. Breakdowns caused by improper use (falls, overloading, wrong fuel) are borne by the renter.

11. Electronic contract and signature

The rental contract is concluded electronically (articles 23 et seq. of Law 34/2002) and signed by means of a simple electronic signature: an on-screen stroke together with a record of the IP address, browser, date and time and the signatory’s email. In accordance with article 25 of Regulation (EU) 910/2014 (eIDAS) and Spanish Law 6/2020 regulating certain aspects of electronic trust services, this signature has full legal effect and serves as evidence in court. You will receive a PDF copy of the contract by email; we will also provide it on request at reservas@ridarentals.com.

The contract is drawn up in Spanish; translations are provided for information purposes and, in the event of discrepancy, the Spanish version prevails.

12. Data protection

Personal data are processed in accordance with the Privacy policy. No images or copies of the identity document or driving licence are stored: only the data needed for the contract and for the mandatory reporting to the Spanish Ministry of the Interior (SES.HOSPEDAJES, Royal Decree 933/2021). The policy also details the retention periods, the handling of the tokenised card and disclosure to the authorities in the event of penalties.

13. Applicable law and complaints

These conditions are governed by Spanish law. Any dispute shall be heard by the courts of the consumer’s domicile or, if the renter is not a consumer, by the courts of Marbella (Málaga).

Official complaint forms of the Regional Government of Andalusia (Junta de Andalucía) are available to customers at our premises and through reservas@ridarentals.com. Consumers may also turn to the Marbella Municipal Consumer Information Office, the Consumer Arbitration Board or the alternative dispute resolution bodies accredited under Spanish Law 7/2017. rida will try to resolve any incident amicably before these routes are used.
