1. Website owner

In compliance with article 10 of Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI-CE), we inform you that the owner of the website https://ridarentals.com (hereinafter, the “Site”) and of the motorbike rental service marketed under the “rida” brand is:

Autoescuela Marbesula is a driving school with premises open to the public in San Pedro de Alcántara (Marbella), Málaga, from which vehicles are handed over and returned.

2. Purpose and acceptance

The purpose of the Site is to provide information about the fleet of 125 cc scooters available for rent in San Pedro de Alcántara and to allow online booking and payment of the service. Accessing and browsing the Site grants you the status of user and implies acceptance of this Legal notice. Contracting the service is also governed by the General rental conditions, the Cancellation policy and the Privacy policy, available on the Site.

The owner may modify at any time the presentation, configuration and content of the Site, as well as this Legal notice. The version in force is the one published at any given time.

3. Use of the Site

The user undertakes to use the Site in accordance with the law, good faith and public order. In particular, it is forbidden to: make fraudulent bookings or bookings with false data; introduce viruses or any malicious code; attempt to access restricted areas (admin panel, staff check-in) or other users’ data; and reproduce or systematically extract the content of the Site (scraping) without authorisation.

To book you must be over 18 and meet the driving licence requirements detailed in the General conditions. The data provided by the user must be accurate and up to date; the user is liable for any damage arising from its inaccuracy.

4. Intellectual and industrial property

The “rida” brand, the logo, the design of the Site, the texts, our own photographs and the source code are owned by Autoescuela Marbesula or by third parties who have authorised their use, and are protected by Spanish and European intellectual and industrial property law. Vehicle makes and models (Piaggio, Vespa, Kymco, etc.) belong to their respective owners and are mentioned solely to identify the fleet.

Viewing, printing and downloading the content for personal, non-commercial use is permitted. Any other use requires the prior written authorisation of the owner.

5. Liability

The owner does not guarantee the uninterrupted availability of the Site or the absence of errors, although it will take reasonable measures to correct them. Vehicle availability and the prices displayed are those in force at the time of consultation; a booking is only confirmed after payment and the sending of the confirmation email.

The owner is not liable for damage arising from improper use of the Site, from the interruption of telecommunications services or of the third-party payment gateway (Redsys), or for the information contained on linked sites.

6. Links

The Site may include links to third-party pages (for example, maps, the driving school’s website or the payment gateway). The owner does not control those pages and is not responsible for their content or privacy policies. Linking to the Site from other pages is permitted provided it is not done for misleading commercial purposes, the content is not reproduced through frames (framing) and no non-existent relationship with the owner is implied.

7. Data protection and cookies

The processing of users’ personal data is described in the Privacy policy. The Site uses only strictly necessary technical cookies and storage (staff session, language and theme), which are exempt from the consent requirement under article 22.2 of the LSSI-CE; for this reason no cookie banner is displayed.

8. Applicable law and jurisdiction

This Legal notice is governed by Spanish law. For any dispute arising from access to or use of the Site, the parties submit to the Courts of Marbella (Málaga), unless the user is a consumer, in which case the courts of the consumer’s domicile shall have jurisdiction, in accordance with Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Protection of Consumers and Users.
